A Roof Under 15 Years Old
An insurer may not refuse to issue or refuse to renew a homeowner's policy on a home with a roof less than 15 years old solely because of the age of the roof.
A Roof 15 Years or Older
The insurer must allow you to have the roof inspected by an authorized inspector, at your expense, before it can require roof replacement as a condition of issuing or renewing the policy. If the inspection shows the roof has five years or more of useful life remaining, the insurer may not refuse to issue or renew solely because of roof age.
Who Counts as an Authorized Inspector
An authorized inspector is one the insurer approves: a licensed home inspector, a certified building code inspector, a licensed general, building or residential contractor or a roofing contractor, a licensed professional engineer, a licensed professional architect, or another individual or entity the insurer recognizes as qualified.
How the Law Counts Roof Age
Roof age runs from the last date 100 percent of the roof surface was built or replaced under the building code in effect at the time. A patch repair does not reset the clock. These rules apply to homeowners' policies issued or renewed on or after July 1, 2022, and not to mobile home policies.
